The Ferraro Law Firm Files Suit on Behalf of Transplant Patient Contaminated By Illegally Harvested Human Tissue

The Ferraro Law Firm, one of the nation's largest claimants' litigation firms, recently announced that their client Carlton Dean was diagnosed with Hepatitis B and C as a result of possible contamination from illegally harvested human tissue distributed from Regeneration Technologies, Inc., Medtronic Sofamor Danek, USA, Inc., and SpinalGraft Technologies, LLC, Biomedical Tissue Services, LTD (BTS), Michael Mastromarino, and Joseph Nicelli. The suit, filed in Broward County on May 30, 2006, contends that Mr. Dean received the news from his surgeon's office that the tissue used in his complicated spinal surgery originated from BTS, which was currently under an FDA investigation for falsifying records.


In two separate cases filed by The Ferraro Law Firm in Alachua County against the above-named defendants on April 26, 2005 on behalf of Leroy Kiddell and Janice Schmitt, the suits contend that Mr. Kiddell and Ms. Schmitt both underwent spinal surgeries wherein the bone grafts they received were also part of the recall prompted by the FDA. In both cases, the Plaintiffs were informed by their surgeons of the alarming news and advised to undergo blood testing.


Plaintiffs counsel David A. Jagolinzer said, "Contrary to recent statements made by the Defendants in the press, people have been injured and seriously -- this is another tragic case of corporate greed at the expense of everyday people that we see in our practice everyday."


As the alarming number of lawsuits continues to increase and hospitals nationwide report on receipt of illegally harvested and potentially dangerous tissue, The Ferraro Law Firm believes that stricter regulations are needed to monitor industry standards.
