No Driver? No Insurance? No Problem - Attorney Carol L. Schlitt Wins $75,000 in Accident Case

Despite a missing driver and a bankrupt insurance company, Carol L. Schlitt announced today that she settled a case for an unnamed client for $75,000 due to injuries her client suffered in collision between two New York City taxis.

This was not your run-of-the-mill Manhattan auto accident. Ms. Schlitt’s client, a woman and her five year old daughter, had just left their friend’s house in Harlem and were heading home to the Bronx in September 1998. Their taxi started to make a left hand turn at an intersection when another cab ran the red light and broadsided their cab. While the little girl suffered no serious injuries, her mother incurred injuries to her back and neck and knee damage so severe that it required surgery.

This would appear to be an open and shut case against the driver of the offending cab except the driver was never to be found again and the insurance company for the renegade cab was bankrupt and unable to pay any award.

The solution? Ms. Schlitt argued that the taxi in which her client traveled violated New York State traffic laws by entering the intersection before it was able to complete the turn. Had the cab driver waited, the cab would not have been in the middle of the intersection and the accident would not have occurred. As a result, the insurance for the driver of the client’s car agreed to pay $75,000.

Ms. Schlitt said, “My client suffered because of the mistakes of two drivers and the fact that one insurance company went bankrupt should not deny her justice.”

The client retained the firm of Crasto and Associates of Howard Beach, New York, who in turn hired Carol L. Schlitt to serve as trial counsel.
