New York City Sanitation Worker Gets $1,000,000 for Slipping and Falling at Work

In 2001, Sanitation Worker Frank Merola was permanently injured while working as a New York City Sanitation Worker. After his day's work, he took a shower in the department garage. As he exited the shower, he was confronted with a re-occurring problem of standing water in the changing room area. He tried to step over the puddle and slipped and fell injuring his lower back. He never returned back to work and was forced to undergo major back surgery including a lumbar fusion. He lost his job due to his disability. The floor of the changing area was not graded correctly and the NYC Department of Sanitation had knowledge of this fact yet failed to correct the problem.

As a result of the injury, he hired Todd J. Strier from the law firm of Kelner & Kelner to represent him. An action was commenced entitled Frank Merola v. The City of New York (Index No. 121156/01). The matter was prepared for trial, however, at the last minute, the City of New York extended an offer of $1,000,000 which was accepted by our client.

In our opinion, it was an excellent recovery given the facts and circumstances of the case. There was always the possibility that a trial would have resulted in a lower award.
