Keller Rohrback L.L.P. Announces Update on the Status of the Dell Inc. 401(K) Plan Litigation -- DELL

Keller Rohrback L.L.P. (www.erisafraud.com), who previously filed an ERISA complaint against Dell Inc. ("Dell" or the "Company") (Nasdaq:DELL) in the United States District Court, Western District of Texas on October 4, 2006, today announced it was broadening its investigation of Dell in light of the Company's recent announcement that the SEC had commenced a formal investigation into certain accounting and financial reporting matters at Dell. In August, the Company had disclosed it was the subject of an informal SEC investigation for unspecified accounting issues.


Additionally, Keller Rohrback today announced that it will file an amended complaint on January 31, 2007, pursuant to a court order signed on November 16, 2006. Court orders and the current ERISA complaint filed by Keller Rohrback may be viewed at: www.erisafraud.com.


Keller Rohrback's ERISA complaint alleges that Dell and the various defendants breached their fiduciary duties owed to the Dell Inc 401(k) Plan participants by: (1) failing to prudently and loyally manage the Plan's assets; (2) failing to provide participants with complete, accurate and material information concerning the problems with Dell's business and financial condition necessary for Participants to make informed decisions concerning the prudence of directing the Plan to invest in the Dell stock fund; and (3) failing to appoint and monitor the performance of the other fiduciaries.
