HyperRoll Files Suit Against Hyperion
19 January 2005HyperRoll Incorporated, the leading innovator in providing data aggregation solutions for business intelligence (BI) applications, today announced the filing of a patent infringement lawsuit by its subsidiary, HyperRoll Israel Ltd. against Hyperion Solutions Corporation (Nasdaq: HYSL). The suit, filed in the United States District Court for the Eastern District of Texas, asserts claims for patent infringement, violation of the Lanham Act, and false patent marking. In its complaint, HyperRoll Israel asserts that Hyperion's recently introduced Essbase 7X products infringe two key patents covering data aggregation, U.S. Patent Nos. 6,385,604 and 6,434,544. The complaint asks the court to order that Hyperion obtain the return of all infringing copies of Essbase 7.1 and 7X, and to issue an injunction to prevent Hyperion from continuing to infringe the HyperRoll patents. The Lanham Act claim stems from Hyperion's access to HyperRoll's commercial aggregation solution for Essbase in 2003 under nondisclosure agreement and its subsequent misrepresentations to the public concerning Essbase 7.1 and 7X. The complaint seeks unspecified monetary damages from Hyperion as well.
