CHF Technologies Inc. Says Chase Medicals Allegations Are Without Merit
19 December 2004CHF Technologies, Inc. ("CHFT"), the Congestive Heart Failure treatment company, responded to the Chase Medical ("Chase") press release regarding Chase Medical's allegations against CHFT.
CHFT has not been served with any complaint by Chase. Nevertheless, CHFT has been apprised that Chase has filed a complaint in the U.S. District Court in Northern Texas, Dallas Division, alleging that CHFT's Blue Egg(TM) left ventricular restoration products infringe one or more claims of U.S. Patent No. 6,681,773 (the "773 Patent"). CHFT said it has not infringed the '773 Patent and believes that claims in the '773 Patent are invalid.
"We believe this lawsuit is without merit and we plan to conduct a vigorous defense," stated Rob O'Reilly, VP of Business Development, CHFT. "CHFT continues to threaten Chase Medical's position in the marketplace and this legal action is an attempt to slow our continued sales momentum. It is a testament to our success that Chase has chosen to compete with us in the courtroom rather than in the marketplace. We remain committed to delivering patented, innovative products and world-class support to assure our customers' continued success."
