Care Home Abuse Solicitor gets Matron and Nurse Struck Off and £45,000 Compensation

Marilyn Payne went to visit her father in December 1999 at the Southover nursing home and found the duty nurse had him trapped in a corner behind two tables and her chair. One of the tables was forced up against his chest, after Marilyn moved the barricade she found her father wet in a puddle of urine.

When Marilyn asked what the nurse was doing to her father, she was told that he had wedged himself in.

It got much worse. In April 2000 Marilyn found her father suffering severe pain and discomfort but the nurses told her that it was being dealt with. When her father became seriously ill and delirious from a severe infection, Marilyn went straight to the GP.

Dennis Payne was admitted to Wrexham Park Hospital in Slough as an emergency in a condition the doctors said was commonly associated with wartime trenches. He had a sore the size of two fists at the base of his spine which had rotten his skin to the bone. Dennis was also suffering from septicaemia, cellulitis, gas gangrene, dehydration and malnutrition.

Marilyn complained about her father s treatment at Southover to the United Kingdom Central Council for Nursing, Midwifery and Health Visiting (now the Nursing and Midwifery Council). The Berkshire Health Authority stonewalled her, she went to various Members of Parliament including Theresa May who replied inanity. She also wrote to The Sunday Times which published her story in November 2000.

Marilyn then received a call from a Pannone Clinical Negligence Solicitor that specialises in nursing home and care home abuse cases. Pannone offered to take up the case on a no-win, no-fee basis.

Pannone commissioned an independent report on Southover which had since been closed down. Last month, former Southover Matron Barbara Slader and night nurse Jane Richardson were found guilty of serious neglect and misconduct, and they were struck off the nursing register. Marilyn has accepted an out-of-court compensation settlement of £45,000.
